
A federal judge has stepped in to block the deportation of Wilber Rafael Garces Perez, a 28-year-old Venezuelan national currently in federal custody. Garces Perez, who is in the country illegally, was shot by ICE agents in Texas this past Sunday.
The incident occurred after agents in an unmarked vehicle attempted an encounter, leading to a pursuit where the suspect allegedly attempted to evade authorities.
While the suspect’s attorney, Kate Lincoln-Goldfinch, claims her client was merely making a food delivery and did not realize he was being pursued by law enforcement, the reality is that the suspect chose to flee from federal agents. The Department of Homeland Security is currently investigating the circumstances of the shooting.
Despite the ongoing investigation and the suspect's status as an illegal alien, Judge Orlando Garcia, a Clinton appointee, has granted a temporary restraining order that prevents the government from deporting the man until at least his scheduled court appearance on September 30.
Activists and Democrat lawmakers are already using the incident to push for the suspect's release and to attack the presence of ICE in the community. As the legal battle unfolds, the focus remains on the suspect's medical care and the procedural hurdles being used to stall his removal from the country.
